Building and Development Policy - Published: 30 Mar 2009

This policy does not apply to Exempt or Complying Development.

 

 The following Building & Development Policy to control the siting and structural standards for the erection of structures within the Weddin Shire Local Government Area.

The provisions of this Policy are to be considered in conjunction with the Environmental Planning & Assessment Act, Building Code of Australia and the Weddin Shire Local Environmental Plan 2002.

Neighbour Notification Policy - Published: 30 Mar 2009

Council will consider the following matters when forming its opinion as to whether or not the enjoyment of adjoining land may be detrimentally affected by a proposed development;

 

i)                    The views to and from the adjoining land/s

ii)                  Overshadowing of the adjoining land/s

iii)                 Privacy of the adjoining land/s

iv)                The likely effect of noise  and odour on the adjoining land/s

v)                  The streetscape

vi)                Type of development

vii)               Likely effect on the built and/or natural environment

viii)             The visual impact on the built and/or natural environment

Development and Planning System in Weddin - Published: 30 Mar 2009
Planning and Development in NSW is carried out under the Environmental Planning and Assessment Act 1979 (EP&A Act) and the Environmental Planning and Assessment Regulation 2000.

Both State and Local Government have roles and responsibilities under the EP&A Act to ensure that all built and natural environments are developed in appropriate and sustainable ways.

The Act provides for different levels of development regulation and guidance relating to State, Regional and Local issues through the following environmental planning instruments: State Environmental Planning Policies (SEPP's) Regional Environmental Plans, (REP's) Local Environmental Plans, (LEP's) Development Control Plans, (DCP's) State.

Regional and local environmental planning instruments indicate what level of assessment is required for development and who is responsible for assessing a development proposal.

For most types of building, subdivision and demolition work, a Development Application (DA) is required to be submitted to Council for approval before any work can commence.

In some cases the consent of Council may be required for the change of use of land or premises (eg when an existing shop is converted to a restaurant).

Contact with Councils Environmental Services Department in the early stages of planning work will assist you in understanding issues relating to the legislation.
